These Terms of Service (“Terms”) govern your use of any work or plans you purchase from HOLDEN DESIGN and your use of this website. By confirming payment, you agree to these Terms.
If you do not agree with these Terms, please do not purchase a plan or use this site.
1. Who you’re dealing with
HOLDEN DESIGN is an independent, one-person operation based in Canada, providing custom digital social media design for real estate professionals. For any questions about these Terms, email: holden@theholden.ca
2. Services
HOLDEN DESIGN provides custom digital design work, mainly: • Social media feed posts for real estate professionals • Delivered as image files (and, where included, suggested captions) Details for each plan (for example, number of posts and timing) are described on the Stripe checkout page and in the materials you receive from me (such as emails or a pitch deck). I do not provide legal, financial, tax, investment, or brokerage advice. Any business or marketing decisions you make are your own responsibility.
3. Orders, payments, and Stripe
Payments are processed securely through Stripe, a third-party payment processor. • When you confirm payment on a Stripe checkout page, you authorise Stripe to charge your payment method in accordance with the amount and frequency shown. • I do not see or store your full card number or security code. For recurring plans, Stripe will clearly display the billing schedule (for example, every 4 weeks) before you confirm payment.
By completing checkout, you confirm that: • You are authorised to use the payment method, and • The information you provide is accurate and complete.
4. Plans and subscription cycles
Each payment corresponds to a defined 4-week cycle of work. For example: • The Core plan involves a specific number of posts over 4 weeks. • The Full plan involves a larger number of posts and additional time-sensitive tiles. The exact scope and deliverables are described on the relevant Stripe checkout page. Work is created and delivered during the 4-week cycle that your payment covers.
In short: • You can stop future billing by emailing holden@theholden.ca • If you are unhappy during your current 4-week cycle and email within that cycle, I refund that cycle’s payment and stop future charges, as described in the policy.
If anything in these Terms conflicts with the Refund & Cancellation Policy, the Refund & Cancellation Policy controls for refund-related matters.
6. Client responsibilities
To deliver the work, I may need: • Basic information about your business and market • Any photos, logos, or brand assets you want incorporated • Access to current listings or example materials
You are responsible for: • Making sure you have the right to use any assets you send (logos, photos, text, etc.), and • Ensuring any factual information or claims you provide are accurate and compliant with your own regulators (for example, real estate boards or licensing bodies). You remain responsible for how you actually use any designs (including any required disclosures or licensing information in your local jurisdiction).
7. Use of deliverables and intellectual property
Unless otherwise agreed in writing: • You receive a license to use the final image files created for you in your own marketing (for example, on Instagram, Facebook, LinkedIn, your website, and presentations to clients). • You may not resell, sublicense, or redistribute the designs as a stand-alone product or as a design package for others. I retain the underlying creative rights and may reuse elements, styles, or approaches in other work.
Portfolio use
By default, I may display non-sensitive examples of your designs (with any private or identifying details removed if needed) in a private or public portfolio, unless you explicitly ask me not to. If you do not want your designs shown in any portfolio context, email: holden@theholden.ca and I will respect that request going forward.
8. No guarantees of results
The work is designed to improve how your marketing looks and feels, but: • There is no guarantee of specific business results (for example, number of leads, sales, listings, or income). • Past outcomes for other clients do not guarantee, promise, or imply future results for you. You are responsible for your own business strategy, pricing, compliance, and client relationships.
9. Privacy
How your personal information is collected, used, and protected is described in the Privacy Policy, which forms part of these Terms. You can read it here: [Privacy Policy] By using this site or purchasing a plan, you consent to the handling of your information as described in that policy.
10. Prohibited uses
You agree not to use this site or any designs for: • Any unlawful purpose • Misleading or deceptive marketing • Activities that violate the terms of platforms you post on (for example, social media community guidelines) • Any use that could reasonably damage the reputation of HOLDEN DESIGN If the way you intend to use the designs conflicts with platform rules or local regulations, you agree to adjust your use accordingly.
11. Limitation of liability
To the maximum extent permitted by law: • HOLDEN DESIGN is not liable for indirect, incidental, consequential, or special damages arising from your use of the designs, this site, or Stripe’s services. • Total liability for any claim related to a specific 4-week cycle of work is limited to the amount you paid for that cycle. Nothing in these Terms is intended to exclude liability where it cannot be excluded under applicable law.
12. Changes to these Terms
These Terms may be updated from time to time to reflect: • Changes in how the business operates • Changes in tools or providers (for example, Stripe or hosting) • New legal or regulatory requirements When changes are made, the “Last updated” date at the top of this page will be revised. Your continued use of the site or purchase of new cycles after changes are posted means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the province of British Columbia and the federal laws of Canada, without reference to conflict of law principles. Any dispute arising out of or relating to these Terms will be handled in the courts of British Columbia, unless otherwise required by applicable consumer law.
